Legal Options for Virginia Car Accidents
When a crash results in both a fatality and multiple injuries, Virginia law provides different avenues for the affected families and survivors. These claims are designed to address the physical, emotional, and financial impact caused by another driver’s negligence.
Virginia Wrongful Death Claims
Because the driver of the Nissan tragically lost their life in the collision, their surviving family members may have grounds to pursue a wrongful death claim under Virginia law. A wrongful death action is filed by the personal representative of the deceased’s estate, and it allows certain beneficiaries (such as a spouse, children, or parents) to seek compensation for:
- Loss of financial support the deceased would have provided
- Loss of companionship, comfort, and guidance
- Medical expenses related to the fatal injury, if any
- Funeral and burial costs
- Emotional losses suffered by surviving family members
The purpose of a wrongful death claim is to hold the responsible party financially accountable and to relieve the economic strain placed on the deceased’s loved ones after an unexpected loss.
Virginia Personal Injury Claims
The individuals inside the Chevrolet Silverado may also have claim. Virginia law allows injured victims to pursue personal injury claims to recover damages for the physical and financial harm. Even though the injured passengers were riding in the vehicle that crossed the median, they may still have legal rights. Under Virginia law, passengers are typically not responsible for the actions of the driver, even if it’s a family member.
- Medical expenses, including ambulance rides, surgeries, hospitalization
- Lost income or diminished earning capacity if injuries affect their ability to work
- Pain and suffering, including ongoing physical discomfort or disability
- Long-term rehabilitation costs or future medical needs
